The 119th Congress was sworn in on January 3, 2025, and President-elect Trump will be inaugurated on January 20, 2025. This presents several opportunities to advance dealer public policy priorities, including the elimination of the Biden Administration EPA’s recent grant of a waiver allowing California to implement its Advanced Clean Cars II (ACC2) program (see NADA’s press release and dealer alert).
The Details:
- ACC2 requires new vehicle sales by vehicle manufacturers to be 35% Zero Emissions Vehicles (ZEVs) for MY2026 and increase to 100% ZEVs in MY2035. Eleven states have adopted California’s strict mandate, in whole or in part.
- NADA has long supported a single, national fuel economy standard that is technologically feasible, economically practicable, and does not restrict consumer choice.
- California’s ZEV mandate possesses none of these features and the CARB states are nowhere close to meeting its requirements.
What NADA is doing:
- NADA has engaged the Trump transition team to express strong support for its intention to direct the EPA to initiate a rulemaking to revoke the CARB waiver.
- NADA is urging congressional leaders to move quickly on legislation – including a Congressional Review Act resolution – to disapprove the waiver.
- NADA also is supporting the efforts of dealer associations in CARB states to eliminate their ZEV mandates.
What you can do:
- Federal legislation to disapprove the CARB waiver has not been introduced yet in Congress but is expected soon.
- When this occurs, NADA will alert dealers on how they can actively engage their Senators and Representatives to support this essential pro-dealer and pro-consumer legislation.
