ATD Update: June 27th, 2023

Written by American Truck Dealers (ATD - NADA) | Jun 29, 2023

The following update was sent via email by ATD Chairman Scott McCandless

What’s new:
The ATD Board of Line Representatives, joined by three OEMs, sent a letter to House Energy and Commerce Chair Cathy McMorris Rodgers (R-Wash.) and Ranking Member Frank Pallone (D-N.J.) urging the Committee to reject H.R. 906, so-called “right to repair” legislation.

The big picture: Although H.R. 906 is being advertised as providing “consumer choice,” it is fatally flawed because it treats heavy-duty trucks the same as light-duty vehicles, and fails to acknowledge the vast differences between commercial and retail consumers, as explained in the June 16 letter.

In a related development, on June 13 the National Highway Traffic Safety Administration (NHTSA) told OEMs not to comply with the Massachusetts “Right to Repair” law based on significant safety concerns with the telematics open access requirement of the law. Because the Massachusetts law conflicts with and therefore preempts the state law, “NHTSA expects vehicle manufacturers to fully comply with their Federal safety obligations” and not the Massachusetts law.

Take action: Reach out to your members of Congress and urge them to not cosponsor H.R. 906 by sharing this issue brief.
